W.E.N.D.Y.™ Identity at Work is a personal workspace.

That is why we designed privacy, access and sharing starting from a simple principle: you decide what to share.

Your work on tasks is private by default

The answers, reflections and Insights you enter during tasks are private by default.

At the end of each task you can freely choose whether to keep them Private or share them with Anna.

Through the App, Anna can read only the runs you have knowingly chosen to share with her.

Access to shared content is read-only: Anna can read your work, but not change it.

Sharing may allow her, where provided, to offer you a more personal Insight or suggest more in-depth work.

The choice is yours.

My Space: you hold the key

MY SPACE is your private space.

Here you can write and keep thoughts, insights, ideas, goals, realisations, phrases, notes and images that mean something to you.

Anna has no access through the App to the content you keep in MY SPACE.

MY SPACE cannot be accessed from the Admin area.

Anna can read only what you knowingly choose to share in the areas of the App where sharing is provided.

It is your space. You hold the key.

WENDY PRIV: when you want to close the door

WENDY PRIV is an additional layer of protection for your personal areas.

Whenever you wish, you can voluntarily activate a temporary lock that prevents protected private content from being displayed for the chosen period.

The lock stays active even if you reload the page or move around the App.

WENDY PRIV does not replace the security of your account.

It is simply extra protection, for the moments when you want to close the door.

And in companies?

The same principle applies.

In future W.E.N.D.Y.™ Enterprise experiences, each person working in the App keeps their own individual space and their own confidentiality rules.

Belonging to an organisation does not automatically make the user’s personal work visible to the company.

Access, sharing and any data available to the organisation will be defined explicitly and transparently in the Enterprise offer.

Individual privacy does not disappear when W.E.N.D.Y.™ enters a company.

The work you do inside W.E.N.D.Y.™ Identity at Work is personal and confidential.

Your answers, reflections and Insights are private by default and are kept in your personal area.

At the end of each task you can freely choose whether to keep them Private or share them with Anna.

If you choose to share them, Anna will be able to read your work in order to offer you, where provided, a more personal Insight or suggest more in-depth work.

The choice is always yours.

W.E.N.D.Y.™ content, models, questionnaires and training are in turn reserved for personal use within the App and remain protected by the related intellectual property rights.

Your work is yours. You decide when to share it.

W.E.N.D.Y.™ Identity at Work collects and uses only the data necessary for the App to function, for managing the account and for providing the available services.

What data we collect

We may process:

• identification and contact data necessary to create and manage the account;
• administrative and tax data, when necessary;
• professional information entered in the profile;
• data relating to the use of the App, progression, tasks completed and Identity Points;
• answers, reflections and other content you choose to enter during your work;
• answers to questionnaires and feedback on the user experience.

W.E.N.D.Y.™ does not require special categories of personal data, such as information on health, religious beliefs, political opinions, ethnic origin or sex life and sexual orientation.

We ask users not to enter this information spontaneously in free-text fields or in their answers.

Your work in the App

Your answers and reflections are private by default.

At the end of each task you can choose to keep them Private or share them with Anna.

When you choose to share content, Anna may consult it to understand the work you are doing and, where provided, offer you a personal Insight or propose more in-depth work.

Questionnaires, feedback and aggregated data

W.E.N.D.Y.™ may collect structured answers to questionnaires and feedback on the user experience.

Some data may be used, in compliance with applicable law and with appropriate minimisation and protection measures, for statistical analysis, pattern observation and the development and improvement of W.E.N.D.Y.™ models and tools.

Where possible, such analyses will be carried out using aggregated or anonymised data.

Payments

Payments for paid services are handled through Stripe.

W.E.N.D.Y.™ Identity at Work does not directly collect or store full payment card details.

W.E.N.D.Y.™ may receive and store only the information necessary to manage the purchase or subscription, such as payment status, active plan, related dates and technical identifiers of the transaction or customer.

Why we use your data

Data is processed to operate the account and the App, keep your progression and the work you have done, provide the requested features, manage any purchased services, ensure security and support, and fulfil administrative and legal obligations.

Protection and retention

We adopt appropriate technical and organisational measures to protect data and limit access to the people and systems that actually need it.

Data is retained for as long as necessary for the purposes for which it was collected and for any obligations required by law.

Your rights

You may exercise the rights granted by applicable data protection law, including, where applicable, access, rectification, erasure, restriction, objection and portability.

You may also request the deletion of your account through the options available in the App.

Data controller

This page clearly sets out the main ways in which W.E.N.D.Y.™ processes personal data.

These General Terms govern the use of W.E.N.D.Y.™ Identity at Work, the subscription to paid plans and the purchase of MicroPlans.

Service owner and provider

1. W.E.N.D.Y.™ Identity at Work

W.E.N.D.Y.™ Identity at Work is a digital platform dedicated to observation, reflection and personal and professional development through tasks, training, questionnaires, tools and activities.

W.E.N.D.Y.™ is structured as a progressive training and not as a content library fully accessible at the time of subscription.

Access to the various activities, features and areas may depend on the subscribed plan, the activities completed, the requirements of each training and, where applicable, the Identity Points earned.

The different plans may therefore allow different modes, breadth and speed of progression.

Subscribing to a plan does not entail the right to immediate and unrestricted access to all content on the platform.

2. Account

To use the reserved features you must create a personal account and complete the required mandatory information.

Users are responsible for keeping their credentials safe and for the use of their account.

The account is personal and may not be transferred to third parties.

3. Plans

W.E.N.D.Y.™ offers:

• Free
• Premium
• Unlimited

Free does not involve paying a subscription.

Premium and Unlimited can be subscribed to monthly or annually, at the prices and with the features shown on the Plans page at the time of subscription.

The subscribed plan determines the features and progression modes available according to the platform rules.

4. Subscriptions and automatic renewal

Premium and Unlimited subscriptions last one month or one year, according to the frequency chosen at purchase.

The subscription renews automatically on expiry until cancelled by the user.

Before purchase, the chosen plan, price, frequency and applicable terms are shown.

Users can manage their subscription through the features available on the platform.

5. Cancellation

Users can cancel their subscription at any time through the features available on the platform.

Cancellation stops automatic renewal and does not entail immediate loss of access to the plan.

Users continue to enjoy the plan until the end of the period already paid.

On expiry, no further renewals or charges are made for the cancelled subscription.

Cancelling the subscription does not delete the account.

The work already done and the user's personal history remain available in My Work, according to the features accessible with the plan available after the subscription expires.

6. Payments

Payments are handled through an external payment service provider.

W.E.N.D.Y.™ does not directly store full details of the user's payment instruments.

If a renewal is not paid, access to the paid plan features may be suspended.

Non-renewal of the subscription does not automatically delete the account or the user's personal history.

7. Subscription suspension

Temporary suspensions of the subscription are not currently available.

If you decide not to continue, you can cancel from your personal Profile.

Cancellation stops automatic renewal and lets you keep using the plan until the end of the period already paid.

8. MicroPlans

MicroPlans are specific digital training programmes that can be purchased separately from the subscription.

They can also be purchased by users on the Free plan, unless specific requirements are expressly stated.

The price, duration and features of each MicroPlan are shown before purchase.

The purchase gives access to the training according to the sequence and modes provided for the chosen MicroPlan.

Content may be made available progressively: the purchase does not necessarily unlock all steps of the training at once.

Purchasing a MicroPlan does not automatically change the user's subscription plan.

9. Right of withdrawal

Users purchasing as consumers may withdraw from the purchase within 14 days of the conclusion of the contract, without giving any reason.

The intention to exercise the right of withdrawal must be communicated by formal notice sent to the certified email (PEC): mindsetsrl@arubapec.it

The withdrawal request must be sent to Mindset Srl and will be handled according to applicable law.

10. Account deletion

Account deletion is distinct from cancelling the subscription.

Users can request the deletion of their account through the features available in the Profile.

Account deletion is irreversible and entails loss of access to the account, to My Work, to the history and to the personal content associated with the account.

Before final deletion, the user is informed of the consequences of the request.

Data that must be retained for administrative, tax or legal obligations, or for establishing, exercising or defending a right, is excluded from immediate deletion, within the limits and for the periods set by applicable law.

The processing of personal data remains governed by the Privacy Policy.

11. Platform evolution

W.E.N.D.Y.™ is an evolving digital service.

Features, training and content may be updated, improved or modified over time for technical, editorial, organisational, security or service development reasons.

Changes do not entail additional costs beyond the subscribed plan, unless the user expressly chooses to purchase a different plan or service.

12. Intellectual property

The content, tasks, questionnaires, texts, models, methodologies, names and materials in W.E.N.D.Y.™ are protected by applicable intellectual property rights.

Purchasing a subscription or a MicroPlan grants only a personal right of use under these Terms.

The materials may not be reproduced, distributed, transferred, published or used professionally without authorisation, except for uses permitted by law.

13. Nature of the service

W.E.N.D.Y.™ is a tool for observation, reflection and personal and professional development.

It does not make diagnoses and does not replace medical, psychological or psychotherapeutic services.

The platform content does not constitute medical, legal, tax or financial advice.

14. Privacy and confidentiality

The processing of personal data is governed by the Privacy Policy available on the platform.

Answers and reflections in tasks are private by default.

Where this feature is available, users can choose to share their work voluntarily.

The rules on My Space, sharing and confidentiality are set out in the Trust Section, the Confidentiality section and the Privacy Policy on this INFO page.

15. Governing law and consumer rights

These Terms are governed by Italian law, without prejudice to the mandatory rights granted to consumers by applicable Italian and European Union law.

16. Availability and acceptance of the Terms

These Terms are available on the platform and can be consulted by the user before purchase.

At checkout the user must be able to consult the General Terms before paying.

Any subsequent changes to these Terms will be made available through the platform in accordance with applicable law.

Access to the W.E.N.D.Y.™ platform and services is reserved for people aged 18 or over who, at this stage, hold an Italian tax code.

Date and place of birth and tax code are requested to verify legal age and the formal consistency of personal details. This check does not constitute certification of personal identity.

The data is processed as described in the Privacy Policy and is not shown to other users.

W.E.N.D.Y.™ Identity at Work is a tool dedicated to observation, reflection and personal and professional development.

The content, tasks, questionnaires, exercises and any Insights available in the App are for training and development purposes and do not constitute diagnosis, treatment or medical, psychological or psychotherapeutic care.

W.E.N.D.Y.™ does not replace the support of qualified professionals when this is needed.

Furthermore, the content and Insights available in the App do not constitute medical, legal, tax or financial advice.

Decisions and actions taken following the work done through W.E.N.D.Y.™ remain the user's responsibility.
